TERMS AND CONDITIONS OF THE ONLINE STORE
§1 DEFINITIONS
- Working days – days from Monday to Friday, excluding public holidays in Poland.
- Civil Code – the Polish Civil Code Act of 23 April 1964.
- Consumer – a natural person entering into a legal transaction with the Entrepreneur that is not directly related to their business or professional activity.
- Account – a digital service that allows the Buyer to use additional features in the Store, governed by separate terms and conditions.
- Buyer – any entity making purchases in the Store or taking actions aimed at making a purchase.
- Entrepreneur – Valery Litvinchuk conducting business activity at Skarbka z Gór 41B/25, 03-287 Warsaw, NIP: 5242948900, REGON: 522978173.
- Store – the online store operated by the Entrepreneur at www.introcandle.com.
- Terms and Conditions – these terms and conditions.

§3 TECHNICAL REQUIREMENTS
- To properly use the Store, the following are required:
a. A device with internet access.
b. An internet browser supporting JavaScript and cookies. - To place an order in the Store, an active email account is also required, in addition to the requirements specified in point 1.
§4 SHOPPING IN THE STORE
- The prices of the products visible in the Store are the total prices for the product.
- The Seller notes that the total price of the order includes the price for the product and, if applicable, the delivery costs, as indicated in the Store.
- The selected product must be added to the shopping cart in the Store.
- The Buyer then selects the delivery method and payment method for the order from the available options in the Store and provides the necessary details to complete the order.
- The order is placed when the Buyer confirms its content and accepts the Terms and Conditions.
- Placing an order is equivalent to concluding a contract between the Buyer and the Seller.
- The Buyer may register in the Store by creating an Account or make purchases without registration by providing their details with each order.

By making purchases in the Store, the Buyer accepts the use of electronic invoices by the Seller. The Buyer has the right to withdraw this acceptance.
§6 ORDER FULFILLMENT
- The order fulfillment time is 1-3 working days from the moment it is placed. Delivery time depends on the chosen delivery method via InPost (courier or parcel locker).
- If the Buyer chooses prepayment, the Seller will start processing the order after receiving the payment.
- The products are delivered only within the territory of the Republic of Poland.
- The available delivery methods in the Store are:
a. Via InPost courier service (courier or parcel lockers).
b. Electronically, to the email address provided by the Buyer during order placement – in the case of digital content.
§7 RIGHT OF WITHDRAWAL
- The Consumer has the right to withdraw from the contract concluded with the Seller via the Store within 14 days without providing any reason.
- The withdrawal period expires after 14 days from the day:
a. On which the Consumer has acquired physical possession of the goods, or on which a third party other than the carrier and indicated by the Consumer acquires physical possession of the goods;
b. On which the Consumer has acquired physical possession of the last good, batch, or part, or on which a third party, other than the carrier and indicated by the Consumer, acquires physical possession of the last good, batch, or part, in the case of a contract for multiple goods delivered separately, in batches, or in parts. - To exercise the right of withdrawal, the Consumer must inform the Seller using the contact details provided in §2 of the Terms and Conditions about their decision to withdraw from the contract by an unequivocal statement (for example, a letter sent by post or email).
- The Consumer may use the withdrawal form template provided at the end of the Terms and Conditions, but it is not mandatory.
- To meet the withdrawal deadline, it is sufficient for the Consumer to send the information regarding their exercise of the right of withdrawal before the withdrawal period expires.
EFFECTS OF WITHDRAWAL
- In the event of withdrawal from the contract, the Seller will refund all payments received from the Consumer, including the costs of delivering the goods (except for additional costs resulting from the Consumer's choice of a delivery method other than the least expensive standard delivery method offered by the Seller), without delay and in any event no later than 14 days from the day on which the Seller is informed of the Consumer's decision to exercise the right of withdrawal.
- The refund will be made using the same means of payment that the Consumer used for the initial transaction unless the Consumer has expressly agreed otherwise; in any event, the Consumer will not incur any fees as a result of the refund.
- Unless the Seller has offered to collect the goods, they may withhold the refund until they have received the goods or until the Consumer provides evidence of having sent the goods back, whichever occurs earlier.
- The Seller requests that the goods be returned to the following address: Skarbka z Gór 41B/25, 03-287 Warsaw, without delay and in any event no later than 14 days from the day on which the Consumer informs the Seller of the withdrawal from the contract. The deadline is met if the Consumer sends the goods before the 14-day period has expired.
- The Consumer bears the direct costs of returning the goods.
- The Consumer is only liable for any diminished value of the goods resulting from the handling of the goods other than what is necessary to establish the nature, characteristics, and functioning of the goods.
- If the goods, due to their nature, cannot be returned by post in the usual manner, the Consumer will also bear the direct costs of returning the goods. The estimated cost of returning such goods will be provided by the Seller in the description of the goods in the Store or during order placement.
- In the event that a refund is necessary for a transaction made by the Consumer with a payment card, the Seller will refund the amount to the bank account assigned to that payment card.
§8 EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
The right of withdrawal from a contract concluded remotely, as mentioned in §7 of the Terms and Conditions, does not apply to a contract:
- Where the subject of the performance is a non-prefabricated item, manufactured according to the Consumer's specification or used to satisfy their individual needs;
- Where the subject of the performance is an item that deteriorates quickly or has a short shelf life;
- Where the subject of the performance is an item delivered in sealed packaging that cannot be returned after opening due to health protection or hygiene reasons, if the packaging was opened after delivery;
- Where the subject of the performance consists of items that are inseparably mixed with other items after delivery due to their nature;
- For the supply of digital content, for which the Consumer is obliged to pay the price, if the following conditions are met:
a. The Entrepreneur has started the performance with the Consumer's express and prior consent;
b. The Consumer was informed before the performance began that, after the performance by the Entrepreneur, they would lose the right of withdrawal from the contract, and they acknowledged this fact;
c. The Entrepreneur has provided the Consumer with confirmation of the contract concluded remotely, including information on the aforementioned consent, on a durable medium within a reasonable time after the conclusion of the contract, no later than before the commencement of performance.
§9 COMPLAINTS
I. GENERAL PROVISIONS
- The Seller is responsible to the Consumer for the conformity of the service with the contract, as provided by generally applicable legal provisions.
- The Seller requests that complaints (including those related to the operation of the Store) be submitted to the correspondence address or email address specified in §2 of the Terms and Conditions.
- If a warranty has been granted for the product, information about it and its terms is available in the Store.
- The Seller will respond to complaints within 14 days from the date of receipt.
II. GOODS
- In the event of non-conformity of the goods with the contract, the Consumer has the option to exercise their rights under applicable legal provisions.
- The Seller is responsible for the non-conformity of the goods with the contract that existed at the time of delivery and was revealed within two years from that moment.
- According to legal provisions, in the case of non-conformity with the contract, the Consumer may request:
a. Replacement of the goods;
b. Repair of the goods. - Additionally, the Consumer may submit a declaration regarding:
a. Price reduction;
b. Withdrawal from the contract in situations where:
a. The Seller refused to bring the goods into conformity with the contract;
b. The Seller failed to bring the goods into conformity with the contract within a reasonable time or without undue inconvenience to the Consumer;
c. The non-conformity of the goods with the contract persists, despite the Seller’s attempts to bring the goods into conformity with the contract;
d. The non-conformity of the goods with the contract is so significant that it justifies a price reduction or withdrawal from the contract without first using the protection measures specified in the legal provisions;
e. The Seller's statement or the circumstances clearly indicate that the Seller will not bring the goods into conformity with the contract within a reasonable time or without undue inconvenience to the Consumer. - In the case of goods subject to repair or replacement, the Consumer should make the goods available to the Seller. The Seller will collect the goods from the Consumer at its own expense.
- The Consumer may not withdraw from the contract if the non-conformity of the goods with the contract is insignificant.
- In the event of withdrawal from the contract, the Consumer will promptly return the goods to the Seller at its own expense, to the address: Skarbka z Gór 41B/25, 03-287 Warsaw. The Seller will promptly refund the price to the Consumer, no later than within 14 days from the date of receipt of the goods or proof of their return.
- The Seller will promptly refund any amounts due to the Consumer as a result of a price reduction, no later than within 14 days from the date of receipt of the Consumer's declaration regarding the price reduction.
- The Buyer is prohibited from providing unlawful content.
- Each order placed in the Store constitutes a separate contract and requires separate acceptance of the Terms and Conditions. The contract is concluded for the time and purpose of fulfilling the order.
- All contracts concluded under these Terms and Conditions are governed by Polish law.
- Contracts concluded under these Terms and Conditions are in the Polish language.
- In the event of a dispute with the Buyer, the court having jurisdiction will be the court competent for the Seller's registered office.
